On 5 December 2022, the European Commission will host a first technical workshop on the effective implementation of Regulation (EU) 2022/1925, the Digital Markets Act.
The Digital Markets Act entered into force on the 1st of November 2022. It is the first global regulation aiming to ensure fair and contestable markets in the digital sector. Moving into the implementation phase, the Commission believes it important for all stakeholders to provide their input and views on various implementation questions, whilst fully respecting the letter and the spirit of the Digital Markets Act.

It’s an important step as the Digital Markets Act aims to prevent self-preferencing at the expense of users of large platform services. The one online retailers are perhaps most concerned about is the ongoing claim that Amazon use your data in order to increase their own sales and decide which products to produce and retail themselves.
The “Applying the DMA’s ban on self-preferencing: how to do it in practice?” workshop will take place on Monday 5 December 2022 in Brussels. This workshop’s aim is to discuss how to ensure effective compliance with Article 6(5) of the Digital Markets Act.
Following the introductory remarks by the Commission, there will be several panels on specific practical questions related to compliance. These include the identification of practices amounting to self-preferencing, detecting the existence of self-preferencing practices and concrete measures to ensure and monitor compliance with Article 6(5) DMA.
Due to capacity constraints, around 60 people can be present in the room. Therefore, physical participation is prioritised for representatives of potential gatekeepers, business users of the gatekeepers’ core platform services (for instance, online search engines and online marketplaces), and civil society representatives such as consumer protection associations. Participation in the room will be limited to one representative per entity/organisation. Other attendees can join the workshop online, with the possibility to ask questions.
